A Mineral County couple is suing the Mineral County Board of Education for allegedly allowing their 15-year-old daughter to be bullied by her schoolmates.

The complaint, filed in U.S. District Court in Martinsburg, alleges the girl has been subjected to “an ongoing pattern of bullying, harassment, torment and persistent continual attacks” throughout the past four years and that Mineral County Superintendent Rob Woy failed to take disciplinary action against the girls who were responsible for the alleged attacks.

It said the girl’s father has “repeatedly” asked the board to create a safe environment for his daughter, whom he said “went from making good grades (As) to now failing.”

Rather than discipline her alleged tormentors, he said the county acted instead by moving his daughter to an alternative school.

“The girls responsible for the bullying should have been suspended from school and prosecuted,” the complaint stated. “However, the superintendent failed to do so and no actions were taken to help the victim.

“In fact, the superintendent suspended the 15-year-old victim as if she was making these stories up and allowed the perpetrators to stay.”

The couple is seeking $100,000 in compensatory damages for the girl’s emotional distress and the pain and suffering the family has endured, plus another $50,000 in punitive damages.
